Terms and Conditions
Validity
(1) The following General Terms and Conditions apply to all contracts, services, and deliveries between Simple Fitness GmbH and its customers.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but rather an non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer makes a binding contractual offer by successfully completing the ordering procedure provided in our online shop.
The order is placed in the following steps:
1) Selection of the desired goods.
2) Confirmation by clicking the "Add to Cart" button.
3) Review of the information in the shopping cart.
4) Clicking the "Checkout" button.
5) Logging into the online shop after registration and entering login details (email address and password).
6) Re-checking or correcting the entered data.
7) Binding submission of the order by clicking the "Order with obligation to pay" or "Buy" button.
Before the binding submission of the order, the consumer can return to the internet page where the customer's details are recorded and correct input errors, or cancel the ordering process by closing the internet browser, by using the "Back" button in the internet browser they are using after checking their details. We confirm the receipt of the order immediately by an automatically generated email ("Order Confirmation"). With this, we accept your offer.
(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order data and our General Terms and Conditions by email. You can view your past orders in our customer area under My Account / My Orders.
Price, Shipping Costs, and Payment
(1) The stated prices include the statutory value-added tax and other price components. Any shipping costs will be added.
(2) Our shipping costs are calculated according to size and weight. The consumer will be informed about this on the "Shipping" page and in the shopping cart, i.e., before completing the purchase.
(3) If the buyer expressly requests express shipping of the goods, they bear the additional costs. In the event of withdrawal, these additional costs shall be borne by them.
(4) Our transactions are processed via Shopify Payments. The consumer has the option of paying by Paypal, Klarna, bank transfer, instant bank transfer, direct debit, credit card, invoice, or installment payment.
(5) If the consumer has chosen payment in advance, they undertake to pay the purchase price immediately after conclusion of the contract.
(6) The prices stated in our shop are carefully checked. Nevertheless, in exceptional cases, incorrect prices may occur. Should we discover a pricing error, we reserve the right to refuse orders placed at an obviously incorrect price. In such cases, we will inform our customers immediately and, if necessary, fully refund any payments already made.
Delivery
(1) Unless we have clearly indicated otherwise in the product description, all items offered by us are immediately ready for shipment.
(2) Our goods are generally delivered for self-assembly, in some cases also partially assembled. Delivery usually takes place within 5-15 working days or as agreed in writing.
(3) If Simple Fitness GmbH cannot meet the agreed delivery deadline, the customer must grant a reasonable extension for delivery.
(4) If Simple Fitness GmbH does not deliver by the end of the extended delivery period, the customer may withdraw from the contract. Disruptions in business operations, cases of force majeure, both at the delivery company and at their sub-suppliers, extend the delivery periods accordingly.
(5) Simple Fitness GmbH is granted a right of withdrawal if, for example, an item is out of stock due to unexpectedly high demand or is no longer produced by the manufacturer, or for other reasons is not delivered by the manufacturer despite repeated requests by the delivery company, or if a case of force majeure exists. A prerequisite for this right of withdrawal is that the goods cannot be obtained from other suppliers. The same applies if the procurement of the goods from another supplier would require an effort that, taking into account the content of the obligation and the principles of good faith, is grossly disproportionate to the customer's interest in performance. In such cases, any claim for damages by the customer is excluded.
Retention of Title
We reserve ownership of the goods until full payment of the purchase price.
Warranty and Liability for Defects
The statutory warranty period is shortened to 12 months.
Transport Damages
Buyers are obliged to inspect the incoming goods immediately upon receipt for completeness and integrity. As a general rule, obvious transport damages, such as defective packaging, must be acknowledged by the driver and reported to us immediately.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract.
Consequences of Withdrawal
If you withdraw from your purchase / the contract, we shall reimburse you all payments we have received from you, with the exception of delivery costs, without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods. We will pick up the goods in consultation with you or provide you with a return label.
The goods must be handed over to the shipping service provider in their original packaging upon return. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the condition, properties, and functioning of the goods. Otherwise, consumers can avoid the obligation to pay compensation for value by refraining from anything that impairs the value of the goods. The right of withdrawal and return applies exclusively to consumers within the meaning of § 13 BGB.
Miscellaneous
Errors, printing/typing errors, price changes and availability in catalogs and online offers are reserved. Offers are only valid while stocks last. All struck-through and old sales prices are recommended prices of the manufacturer or our previous sales prices.
